This Privacy Policy describes how Pacific West Academy (“PWA,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in compliance with the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), California Online Privacy Protection Act (CalOPPA), the CAN-SPAM Act, and other applicable laws. Please read this policy carefully.

  • Financial information: Payment data for course enrollment (processed by third-party gateways — we do not store credit card numbers)

  • Analytics data: Collected via Google Analytics and similar tools

  • Referral data from advertising partners or affiliate sites

Notice at Collection (Required by CCPA § 1798.100): We collect the categories above for the purposes described in Section 3. If you do not wish to provide personal information, you may choose not to submit forms or contact us — however, some services may not be available without it.

  • To send program information, updates, and marketing communications (where you have consented or have an existing relationship with us)

  • To detect and prevent fraud and security incidents
  • To follow up after correspondence (live chat, email, or phone inquiries)

We will not use your personal information for purposes materially different from those stated above without providing you with prior notice and, where required by law, obtaining your consent.

We Do Not Sell Your Personal Information

Pacific West Academy does not sell your personal information to third parties for monetary consideration.

Sharing for Business Purposes

  • Website hosting and technical infrastructure providers
  • Email marketing platforms
  • Payment processors (who handle data under their own privacy policies)
  • Analytics providers (including Google Analytics)
  • Advertising platforms (including Google AdSense/DoubleClick)

All service providers are contractually required to keep your information confidential and use it only for the services they provide to us.

Sharing for Advertising Purposes

We use Google AdSense and related Google advertising services on our Site. Google, as a third-party vendor, may use cookies to serve ads based on your prior visits to our Site and other sites. This may constitute “sharing” of personal information under CCPA.

Legal Disclosures

We may disclose personal information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect our rights, property, or the safety of our users or the public.

Business Transfers

In the event of a merger, acquisition, or sale of assets, personal information may be transferred to the successor entity. We will provide notice of any material change in how your data is used as a result of such a transfer.

5. Your California Privacy Rights (CCPA/CPRA)

    You have the right to request that we disclose: (a) the categories of personal information we have collected about you; (b) the categories of sources; (c) our business or commercial purposes for collecting it; (d) the categories of third parties with whom we share it; and (e) the specific pieces of personal information we have collected about you.
  • Right to Delete
    You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (e.g., where retention is required for legal compliance or to complete a transaction).
  • Right to Correct
    You have the right to request correction of inaccurate personal information we maintain about you.
  • Right to Opt Out of Sale/Sharing
    You have the right to opt out of the sale or sharing of your personal information. While PWA does not sell personal data, we do share data with advertising partners (see Section 4C). To opt out, email us at info@pwa.edu with the subject line “Do Not Share My Personal Information” or use the opt-out tools listed in Section 4C.
  • Right to Limit Use of Sensitive Personal Information
    You have the right to limit our use of sensitive personal information to what is necessary to provide our services.
  • Right to Non-Discrimination
    We will not discriminate against you for exercising any of your CCPA rights. We will not deny you services, charge different prices, or provide a different level of service because you exercised your privacy rights.

We will confirm receipt of your request within 10 business days and respond substantively within 45 calendar days (extendable by an additional 45 days with notice). We may need to verify your identity before fulfilling your request.

You may authorize an agent to submit a request on your behalf. We will require written authorization and may verify your identity directly.

6. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate and improve our Site. Cookies are small files placed on your device by your browser.

  • Functional (Always Active): Required for core site functionality
  • Preferences: Remember your settings and preferences
  • Statistics: Anonymized data to understand how visitors use our Site (e.g., Google Analytics)

7. How We Protect Your Information

  • Access controls limiting data access to authorized personnel only
  • Regular malware scanning
  • Secure third-party payment gateway processing (we do not store credit card numbers on our servers)

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, or as required by law. Specifically:

Contact form submissions and inquiry records: Up to 3 years

Enrollment and student records: As required by California Bureau for Private Postsecondary Education (BPPE) regulations

  • Marketing contact lists: Until you opt out or request deletion
  • Website analytics data: Up to 26 months (Google Analytics default)

Upon expiration of the applicable retention period, or upon a valid deletion request, we will securely delete or anonymize your personal information.

9. Email Communications and CAN-SPAM Compliance

We collect email addresses to send program information, respond to inquiries, and for marketing communications with existing and prospective students.

In accordance with the CAN-SPAM Act, we commit to:

  • Not using false or misleading subject lines or sender information
  • Identifying marketing emails as advertisements where applicable
  • Including our physical address (16117 Covello St, Van Nuys, CA 91406) in all commercial emails
  • Honoring opt-out and unsubscribe requests promptly (within 10 business days)
  • Including a clear unsubscribe mechanism in every marketing email

To unsubscribe from marketing emails, click the “Unsubscribe” link in any email we send, or email info@pwa.edu with the subject line “Unsubscribe.”

10. Children’s Privacy (COPPA)

Our Site and services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected information from a child under 13, we will promptly delete it. If you believe we have collected such information, please contact us at info@pwa.edu.

For consumers aged 13–15, we will not sell or share their personal information without their affirmative opt-in consent, as required by CCPA § 1798.120(c).

11. Do Not Track

We honor Do Not Track (DNT) browser signals. When a DNT signal is detected, we will not deploy tracking cookies or use advertising targeting technologies for that session.

12. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify affected individuals in the most expedient time possible and without unreasonable delay, in compliance with California Civil Code § 1798.82. Notification will include:

  • A description of the type of information involved
  • What happened and when
  • Steps we are taking to address the breach
  • Steps you can take to protect yourself
  • Contact information for questions

Notification will be provided via email to the address on file and/or by posting a notice on our website.

13. Third-Party Links and Services

Our Site may contain links to third-party websites or services. This Privacy Policy does not apply to those external sites. We encourage you to review the privacy policies of any third-party sites you visit. We have no responsibility or liability for the content or privacy practices of linked third-party sites.

14. California Online Privacy Protection Act (CalOPPA)

In compliance with CalOPPA, we agree to the following:

  • Users may visit our Site anonymously
  • A link to this Privacy Policy appears in the footer of every page of our Site
  • You will be notified of any material changes to this Privacy Policy on this page, and where appropriate, by direct communication
  • You may request to review or update your personal information by emailing info@pwa.edu

15. Updates to This Privacy Policy

We review and update this Privacy Policy at least annually, as required by CCPA, and promptly when material changes to our data practices occur. The “Last Updated” date at the top of this policy reflects the most recent revision.

If we make material changes, we will notify you by email (to the address associated with your account or inquiry) and/or by posting a prominent notice on our Site prior to the change becoming effective.
